Wealth Changes The Stakes

When the marital estate includes pre-IPO equity, founder stock, vested and unvested RSUs, carried interest, closely held businesses, and real estate across multiple jurisdictions, a guideline divorce is not enough. The wrong characterization, the wrong valuation date, or the wrong support structure can cost millions.

Boyd Law APC represents principals, executives, and their spouses in the financial complexity that defines a high net worth divorce in Pacific Heights -- quietly, strategically, and with the technical depth these matters demand.

Practice Areas

Where Complexity Concentrates

Five areas drive most of the financial outcome in a high net worth divorce. Each requires a different specialist's instinct.

-- 01 --

Restricted Stock Units (RSUs)

For executives at public technology and finance employers, RSUs are often the largest single asset on the balance sheet -- and the most commonly mischaracterized in divorce.

  • Time-rule apportionment of vested and unvested grants
  • Hug, Nelson, and hybrid formula analysis
  • Past-service vs. future-service grant characterization
  • RSU income treatment for support (Ostler-Smith)
  • Tax-aware division and constructive trust structures
-- 02 --

Stock Options & Equity Comp

ISOs, NSOs, performance shares, ESPPs, and pre-IPO equity each carry distinct vesting, tax, and characterization rules under California community property law.

  • Apportionment of unvested ISO and NSO grants
  • Liquidity event modeling and tax projections
  • Pre-IPO valuation and 409A considerations
  • Carried interest, profits interests, and clawbacks
  • Section 83(b) implications and lockup analysis
-- 03 --

Business Owners & Founders

Closely held companies, professional practices, and venture-backed startups demand careful valuation, goodwill analysis, and a buyout structure that preserves the operating business.

  • Forensic valuation: income, market, and asset approaches
  • Personal vs. enterprise goodwill (Pereira / Van Camp)
  • Buyout structuring and equalization payments
  • Operating agreements, buy-sell, and transfer restrictions
  • Coordination with corporate counsel and CFOs
-- 04 --

Spousal & Child Support

For high-income earners, guideline calculators break down. Marital standard of living, bonus and equity income, and Family Code section 4320 analysis become the real battleground.

  • Marital standard of living analysis (FC § 4320)
  • Ostler-Smith bonus and RSU support orders
  • High-income child support deviations
  • Imputation of income and lifestyle analysis
  • Trusts, distributions, and pass-through income
-- 05 --

Complex Asset Division

Real estate portfolios, hedge fund and private equity interests, art and collectibles, crypto, and trusts each require their own valuation and division strategy.

  • Multi-jurisdictional real estate division
  • Hedge fund, PE, and venture interests
  • Cryptocurrency tracing and valuation
  • Trusts, family LLCs, and estate planning interplay
  • Separate property tracing and commingling claims
-- 06 --

Premarital & Postnuptial

The strongest financial outcome often begins long before separation. We draft and review enforceable agreements that anticipate equity events, business growth, and inheritance.

  • Prenuptial agreement drafting and review
  • Postnuptial agreements and transmutations
  • Equity grant and IPO planning
  • Inheritance and gift protection
  • Coordination with estate and tax counsel

Frequently Asked

High Net Worth Divorce, Answered

How are RSUs divided in a California divorce?

Restricted Stock Units are apportioned based on whether they were granted for past, present, or future services and on the proportion of the vesting period that overlapped the marriage. California courts generally apply time-rule formulas -- most commonly Hug or Nelson -- to allocate vested and unvested RSUs between community and separate property. Sophisticated grants, refresh grants, and equity-as-income for support all require their own analysis.

Are unvested stock options community property in California?

They can be -- partially. California treats unvested options as a form of compensation that may be community, separate, or both, depending on grant purpose and vesting schedule. The court applies a time-rule formula to apportion the option between separate and community property based on the dates of grant, vesting, marriage, and separation.

How is a closely held business valued in divorce?

A forensic valuation typically combines the income, market, and asset approaches. Goodwill -- both enterprise goodwill (transferable with the business) and personal goodwill (attached to the owner) -- must be analyzed. The valuation date can materially change the outcome and is often itself the subject of negotiation or motion practice.

How is spousal support set for high earners in San Francisco?

For high-income earners, courts routinely deviate from guideline calculators and apply the marital standard of living analysis under Family Code section 4320. Bonuses, RSU vesting, carried interest, and equity events are often handled through Ostler-Smith fractional support orders rather than fixed monthly amounts.

Do you represent clients in Pacific Heights?

Yes. Boyd Law APC is rooted in Pacific Heights, San Francisco -- handling high net worth and complex asset divorce matters with the discretion these engagements require.

Is the initial consultation confidential?

Yes. Communications with the firm are protected by attorney-client privilege from the moment we begin a confidential consultation, and the firm's intake protocols are designed for clients who require absolute discretion.

Family Law & Divorce

Areas We Handle

A focused family law practice serving Pacific Heights and the greater San Francisco Bay Area. Sophisticated representation in the matters that define the financial and personal stakes of a high-net-worth divorce.

01Practice Area

Divorce & Legal Separation

California is a no-fault state, but the path you choose — dissolution of marriage, legal separation, or annulment — carries significant tax, residency, health-insurance, and estate-planning consequences. The first decisions made in a case often shape every outcome that follows.

We guide clients through the strategic choice between settlement, mediation, collaborative divorce, and litigation — selecting the approach that best protects the client’s privacy and financial position from the moment representation begins.

What We Handle

  • Dissolution of marriage
  • Legal separation
  • Annulment
  • Date of separation disputes
  • Automatic temporary restraining orders (ATROs)
  • Preliminary & final declarations of disclosure
  • Mediation & collaborative divorce
  • Litigation strategy and trial work
02Practice Area

Child Custody & Parenting Plans

California courts decide custody under the best interest of the child standard, weighing health, safety, welfare, frequent and continuing contact with both parents, and any history of abuse or substance use. The outcome depends on how those factors are presented — not just argued.

We draft detailed parenting plans that anticipate real life and coordinate with custody evaluators, minors’ counsel, and co-parenting professionals where appropriate.

What We Handle

  • Legal & physical custody orders
  • Parenting plans and time-share schedules
  • Holiday, school-year & summer rotations
  • Decision-making authority (education, medical, religion)
  • Right of first refusal
  • International travel & passport provisions
  • Custody evaluations & minors’ counsel
  • Modifications and enforcement
03Practice Area

Child & Spousal Support

Guideline calculators tell only part of the story. For high-income earners, courts routinely deviate from guideline child support and apply a full marital standard of living analysis under Family Code section 4320 for spousal support — accounting for bonuses, RSU vesting, carried interest, distributions, and lifestyle.

We coordinate the tax and estate-planning consequences of every support structure, from temporary orders through long-term enforcement.

What We Handle

  • Temporary & permanent support orders
  • Marital standard of living analysis (FC § 4320)
  • Ostler-Smith fractional bonus & equity orders
  • High-income child support deviations
  • Vocational evaluations & imputation of income
  • Income from trusts & pass-through entities
  • Modifications when income or custody changes
  • Enforcement, contempt, and arrears
04Practice Area

Property Division & Complex Assets

California is a community property state: assets and debts acquired during marriage are presumptively divided equally. The complexity is in the characterization — what is community, what is separate, and what has been transmuted, commingled, or improved with the other estate’s contributions.

Where tracing, valuation, or forensic accounting is required, we coordinate with the right experts to support the analysis the court will see.

What We Handle

  • Real estate, including multi-jurisdictional holdings
  • Retirement accounts & QDROs
  • Restricted stock units (RSUs) & stock options
  • Pre-IPO equity and founder stock
  • Closely held businesses & goodwill (Pereira / Van Camp)
  • Hedge fund, private equity, carried interest
  • Cryptocurrency tracing and valuation
  • Art, collectibles, and intellectual property
  • Trust interests and estate planning interplay
  • Separate property tracing & commingling claims
05Practice Area

Same-Sex Divorce & Parental Rights

Same-sex couples have full marital rights under California and federal law following Obergefell, but their cases often carry unique complexities: relationships that began as registered domestic partnerships and converted to marriage, pre-marriage cohabitation that affected community property, assisted reproduction, surrogacy, and second-parent or stepparent adoption.

We protect parental rights for both biological and non-biological parents and structure agreements that travel with the family across all 50 states.

What We Handle

  • Dissolution of marriage
  • Registered domestic partnership dissolution
  • Parentage actions (Uniform Parentage Act)
  • Confirmatory adoptions for 50-state recognition
  • Assisted reproduction & surrogacy agreements
  • Second-parent & stepparent adoption
  • Non-biological parent rights
  • Pre-marriage cohabitation & property issues
06Practice Area

Move-Away & Relocation

A move-away request — to another county, state, or country — is among the most consequential motions in family law. California courts decide these cases under the LaMusga factors, weighing the children’s interest in stability, the distance of the move, the relationship with each parent, the reasons for the proposed move, and the existing custodial arrangement.

Whether you are the parent seeking to relocate or the parent opposing a move, the case is usually won or lost on preparation.

What We Handle

  • LaMusga factor analysis & case strategy
  • Detailed declarations & evidentiary hearings
  • Expert witnesses for child welfare and education
  • Articulated parenting plans for the new arrangement
  • Cross-state relocation matters
  • International relocation & Hague Convention issues
  • Emergency protective orders
  • Opposition motions and trial advocacy
07Practice Area

Premarital & Postnuptial Agreements

The strongest financial outcome often begins long before separation. We draft and review enforceable premarital and postnuptial agreements that anticipate equity events, business growth, inheritance, and the realities of high-net-worth marriages.

Each agreement is built to withstand challenge and to coordinate with estate, tax, and corporate planning that has already been put in place.

What We Handle

  • Premarital agreement drafting and review
  • Postnuptial agreements & transmutations
  • Equity grant and IPO planning
  • Inheritance and gift protection
  • Business owner & founder protections
  • Coordination with estate and tax counsel
  • Independent counsel and enforceability review
  • Spousal waivers in retirement & estate plans
08Practice Area

Domestic Violence & Restraining Orders

Domestic violence and restraining order proceedings under the Domestic Violence Prevention Act (DVPA) can affect every other aspect of a family law case — custody, support, residence, and firearms rights.

We represent both petitioners and respondents with the discretion these matters require, recognizing that the right outcome turns on careful evidence and a focused legal theory.

What We Handle

  • Domestic violence restraining orders (DVROs)
  • Emergency protective orders (EPOs)
  • Civil harassment restraining orders
  • Workplace and elder abuse restraining orders
  • Defense against unfounded restraining order petitions
  • Custody implications under FC § 3044
  • Modifications, terminations, and renewals
  • Cross-jurisdictional enforcement
09Practice Area

Post-Judgment Modifications & Enforcement

A judgment is the start of the next chapter, not the end of the case. Custody arrangements, support orders, and property judgments often need to be modified as circumstances change — or enforced when one party stops complying.

We handle modifications and enforcement with the same rigor as the original case, including contempt proceedings when necessary.

What We Handle

  • Custody & visitation modifications
  • Child support modifications
  • Spousal support modifications & terminations
  • Enforcement of judgments and orders
  • Wage assignments & income withholding
  • Contempt proceedings
  • Set-aside motions and appeals
  • Post-judgment property issues

An early conversation shapes the entire outcome. Speak directly with a senior attorney, by appointment, with strict confidentiality.
